FGC Motors S.r.l. with registered office in via Vittorio Veneto 34/C – 20092 Cinisello Balsamo (MI), Tax Code and VAT Number: 13603010961, Rea: 2733217 (hereinafter, “Owner”), owner of the website https://www.fgcmotors.it (hereinafter, the “Site”), as the controller of the personal data of users who browse and are registered on the Site (hereinafter, the “Users”) provides the following privacy policy pursuant to art. 13 of EU Regulation 2016/679 of 27 April 2016 (hereinafter, “Regulation” or “Applicable Regulation”).
This Site and any services offered through the Site are reserved for individuals who have reached the age of eighteen. The Data Controller does not collect personal data relating to persons under the age of 18. Upon request of Users, the Data Controller will promptly delete all personal data inadvertently collected and relating to persons under the age of 18.
The Owner takes the utmost account of the right to privacy and protection of personal data of its Users. For any information in relation to this privacy policy, Users may contact the Data Controller at any time, using the following methods:

1. Purpose of processing
The personal data of Users will be lawfully processed by the Data Controller pursuant to art. 6 of the Regulation for the following processing purposes:
- browsing the site, in relation to the possibility of detecting the User's data necessary at a technical level, such as e.g. the IP address, while browsing the site.
- response to your requests for information, sent to us via the appropriate contact form
- legal obligations, or to fulfill obligations established by law, by an authority, by a regulation or by European legislation.
The provision of personal data for the processing purposes indicated above is optional but necessary, since failure to provide them will make it impossible for the User to navigate the site, register on the Site and use the services offered by the Owner on the Site.
2. Additional processing purposes: marketing and newsletter (sending advertising material, direct sales and commercial communication)
With the free and optional consent of the User, some personal data of the User (i.e. the name, surname, email address, complete shipping address, information on the vehicle, any insurance, guarantees and services connected to the vehicle itself, etc.) may also be processed by the Owner for marketing and newsletter purposes (sending advertising material, direct sales, commercial communication, sending newsletters containing information in relation to news relevant to the sector relating to the activities of the Site), or so that the Owner can contact the User by post, email, telephone (landline and/or mobile, with automated calling systems or call communication with and/or without the intervention of an operator) and/or SMS to propose to the User the purchase of products and/or services offered by the same Owner and/or by third-party companies, present offers, promotions and commercial opportunities. In the event of failure to consent, the possibility of registering on the Site will not be affected in any way.
In the event of consent, the User may revoke it at any time by making a request to the Owner using the methods indicated in the following paragraph 9.
The User may also easily oppose further sending of promotional communications and newsletters via email by clicking on the appropriate link for revoking consent, which is present in each promotional email and newsletter. Once consent has been revoked, the Owner will send the User an email to confirm that consent has been revoked. If the User intends to withdraw his/her consent to the sending of promotional communications by telephone, but continues to receive promotional communications by email, or vice versa, please send a request to the Owner using the methods indicated in the following paragraph 9.
The Owner informs that, following the exercise of the right to object to the sending of promotional communications and newsletters by email, it is possible that, for technical and operational reasons (e.g. formation of contact lists already completed shortly before the Owner receives the request to object) the User continues to receive some additional promotional messages and newsletters. If the User continues to receive promotional messages and newsletters after 24 hours have passed since the exercise of the right to object, please report the problem to the Owner, using the contacts
indicated in the following paragraph 9.
3. Additional processing purposes: profiling
With the free and optional consent of the User, the User's personal data (i.e. personal and contact details, information relating to the services in which the User has expressed interest, information on the vehicle, any insurance, guarantees and services connected to the vehicle itself) may also be processed by the Owner for profiling purposes, i.e. to reconstruct the User's tastes and consumption habits, identifying their consumer profile, in order to be able to send the User commercial offers consistent with the identified profile. In the event of failure to consent, the possibility of registering on the Site will not be affected in any way.
In case of consent, the User may revoke it at any time by making a request to the Owner in the manner indicated in the following paragraph 9.
4. Further communications: communication of data to the Owner's Partners
With the free and optional consent of the User, the User's personal data (i.e. name, surname, address, email address, telephone number, information on the vehicle, any insurance, guarantees and services connected to the vehicle itself, etc.) will be communicated by the Owner to companies with which the Owner has co-marketing relationships (collectively, the "Owner's Partners"), belonging to the automotive commercial categories.
The Owner's Partners, as independent data controllers, will process the User's personal data for their own marketing purposes (direct sales, sending advertising material and commercial communication), and may contact the User by post, email, telephone (landline and/or mobile, with automated calling or calling communication systems with and/or without the intervention of an operator) and/or SMS and/or MMS to propose to the User the purchase of products and/or services offered by the same categories of third-party companies and/or by other companies and to present the User with offers, promotions and commercial opportunities. Once the transfer has taken place, it will be the responsibility of the Owner's Partner to provide Users pursuant to art. 14 c. 3 of the Regulation, all the information required by the same art. 14 of the Regulation. In the event of failure to consent, the possibility of registering on the Site will not be affected in any way.
In case of consent, the User may revoke it at any time by making a request to the Owner using the methods indicated in the following paragraph 9.
The Owner informs that the User's personal data will be processed by the Owner's Partners as independent data controllers, on the basis of the specific information that will be released by the Owner's Partners to the Users. Any requests not to receive further commercial communications from the Owner's Partners, to whom the data has already been communicated by the Owner, must therefore be addressed directly to them.
5. Social media connect
This site also incorporates plugins and/or buttons in order to allow easy sharing of content on your favorite social networks. When you visit a page of our website that contains a plugin, your browser connects directly to the servers of the social network from where the plugin is loaded, which server can track your visit to our website and, if applicable, associate it with your social account, in particular if you are connected at the time of the visit or if you have recently browsed one of the websites containing social plugins. If you do not want the social network to record data relating to your visit to our website, you must log out of your social network account and, probably, delete the cookies that the social network has installed in your browser. 6. Methods of processing and data retention times
The Owner will process the personal data of Users using manual and IT tools, with logic strictly related to the purposes themselves and, in any case, in a way that guarantees the security and confidentiality of the data. The personal data of the Users of the Site will be retained for the time strictly necessary to carry out the primary purposes illustrated in the previous paragraph 1, or in any case as necessary for the protection in civil law of the interests of both the Users and the Owner.
In the cases referred to in the previous paragraph 3, the personal data of the Users will be retained for the time strictly necessary to carry out the purposes illustrated therein and, in any case, within the limits of the Applicable Regulations.
7. Legal basis for processing
With reference to the purposes referred to in points (1/a and 1/c), the legal basis for processing is in fact the execution of the services provided through the Site and requested by you (pursuant to Article 6, paragraph 1, letter b of the Privacy Regulation 2016/679); with reference to the optional purposes referred to in points (1/e, 1/f) of the previous paragraph, the legal basis for processing is your freely expressed consent (pursuant to Article 6, paragraph 1, letter a of the Privacy Regulation 2016/679); with reference to the purposes referred to in points (1/b, 1/d) of the previous paragraph, the legal basis for processing is to fulfill a legal obligation to which the Owneris subject (pursuant to Article 6, paragraph 1, letter c of the Privacy Regulation 2016/679). With regard to purposes 2, 3 and 4, the legal basis is your optional consent (pursuant to art. 6, paragraph 1, letter a of the Privacy Regulation 2016/679).
8. Scope of communication and data sharing
The personal data of Users may be disclosed to the employees and/or collaborators of the Owner in charge of managing the Site. These individuals, who are formally appointed by the Owner as “data processors”, will process the User’s data exclusively for the purposes indicated in this information notice and in compliance with the provisions of the Applicable Regulations.
The personal data of Users may also be disclosed to third parties who may process personal data on behalf of the Owner as “External Data Processors”, such as, by way of example, suppliers of IT and logistics services functional to the operation of the Site, suppliers of outsourcing or cloud computing services, professionals and consultants.
Users have the right to obtain a list of any data processors appointed by the Data Controller, by making a request to the Owner using the methods indicated in the following paragraph 9.
